BoDean Asphalt- Order for Stay in Court May 15th

Citizens for Safe Neighborhoods will be asking the courts to issue a stay order to halt the construction of the expansion of the BoDean Asphalt Plant.  The hearing is scheduled for this Wednesday, May 15th at 3 p.m. at Dept. 16 Empire College Annex, 3035 Cleveland Ave, Suite 200, Santa Rosa. Interested neighbors and residents are invited to show their support at the hearing.

Citizens has filed a lawsuit against the City of Santa Rosa (Citizens for Safe Neighborhood vs. City of Santa Rosa, SCV- 252028) to ask the courts to require the City of SR to prepare an EIR for the plant that would fully analyze the project’s impacts and review alternative sites for the proposed expansion. The suit would also require the City to set thresholds beyond which the plant couldn’t not intensify the negative effects of the legal nonconforming use.

 The stay is being sought to prevent potentially harmful impacts from occurring while the suit is being heard. The CA Dept. of Health confirmed in December 2012 that Citizens’ concerns were supported and that the City of Santa Rosa’s conclusion of no impact is unfounded. The project’s extent of emissions, air pollutants and health and safety impacts on residents, workers and children is unknown.
